As DNA testing has expanded and developed in that last two decades one item of debate is whether or not a paternity DNA test should be a requirement for all births that take place in a hospital setting. My research led me to see that nearly ninety five percent of births go uncontested and no sort of testing is required or asked for. Whomever is present at the time of birth and agrees to sign the birth certificate is the child’s father.

In some cases we have seen many years down the road that something happens in the relationship of the parents where suddenly there is some kind of question as to the correct parents of the child. So the argument is that at the point of birth, should the child and father undergo DNA testing. On the plus side this would end the argument from day one about who the father is. There are other camps with the belief that this is a violation of rights and also is invasive for the baby. I believe that the parents should have the choice, but that it should not be required. What I would ask is that law makers create the law for the birth certificate to be very specific. For example, once the father agrees to signing that birth certificate, they are indeed the father of that child without any possible revocation of such, irregardless of any pending circumstances, even if the mother has duped the father into believing something that just isn’t true. Once signed, it should be a done deal.

Parents who wish to teach their children at home may do so when the person teaching meets requirements. They must:

• Have a baccalaureate degree.

• Or be qualified to teach.

• Or enroll the child in a correspondence course approved by the board of education.

• Or provide a program of study that includes the Standards of Learning Objectives adopted by the board of education for language arts and math, along with evidence they can provide an adequate education.

• Parents with conditional exemptions also must provide either test scores from approved tests showing the child scoring in the 40th percentile or better or provide some evaluation that in the judgment of the school superintendent shows adequate progress.

To receive a conditional exemption, parents must notify their local school superintendent each August that they will be teaching their child at home and they must provide a description of the curriculum and evidence that they meet the requirements for teaching.

By Aug. 1 following a home schooling year, the parent must provide test scores or evaluation materials. If the superintendent determines that progress is inadequate, other teaching arrangements that comply with the law must be made.

Parents who wish to contest a superintendent’s finding may appeal the decision within 30 days to an independent hearing officer, a paid attorney whose name is taken from a list maintained by the executive secretary of the state Supreme Court for hearing appeals of the placements of handicapped children.

When cases on behalf of handicapped children are heard, their parents do not bear the costs of the proceedings; but when non-handicapped children of appealing home-school families are involved, their parents pay the hearing costs.

The Virginia Department of Education maintains a list of approved home study courses that parents may wish to use in teaching their children at home. Ironically, some of the courses most often used do not submit their materials to state boards for approval.
